Indeed, as the people of knowledge have explained, Islām has no place for the heretical ideologies of the Baʿthiyyah, nor does Islām accept Ṣaddam's hypocritical attempts to appease the Muslims and thereby convince them to be in his favour.

  He is a disbeliever, even if he says 'Lā ilāha illa-Allāh', fasts and prays. As long as he does not free himself from the heretical ideology of the Baʿthiyyah (socialism, communism) and openly proclaims his repentance to Allāh from it and whatever else he used to call to.


Decisive verdicts from the likes of Shaykh al-Islām Ibn Bāz and al-Muḥaddith Muqbil Ibn Hādī al-Wādiʿī concerning one who has brought about much harm and transgression upon the Muslims. Indeed, as the people of knowledge have explained, Islām has no place for the heretical ideologies of the Baʿthiyyah, nor does Islām accept Ṣaddam's hypocritical attempts to appease the Muslims and thereby convince them to be in his favour.

Important Note: This question was presented to Shaykh Aḥmad al-Najmī concerning Ṣaddam Hussain on Saturday the 18th of Dhul Hijjah/ 6th January, 2006.

It reads:

Many questions have been asked concerning Ṣaddam Hussain and the position of the Muslim with regards to him, (and the fact that) he declared the shahadatan (declaration of Islām) as was seen (video recording), and other than that.  (The question is) what is the (correct) position of the student of knowledge in this matter, and should one send peace upon him or not?

The Shaykh responded:

All praise is for Allāh, and may much peace and blessings be upon the Messenger of Allāh, and upon (the Messenger's) family and companions. In reality, the belief of the communist is a disbelieving belief. I have read what Ṣaddam did in Iraq from the spilling of blood (killing) and the closing of the masajid from the worshippers and forbidding them from entering them, as well as the spreading of evil and other than that of affairs that took place from him.  There is no doubt that these sort of actions are disbelief because the communist belief is disbelief.  But the fact that he was jailed for an extended period of time and he declared the shahadatan (declaration of Islām) before being hung at the time of his death, based on that, we declare him to be a Muslim and we leave his affair to Allāh -ʿAzza wa-Jall. We also say that there is no harm in praying over him.  If a person is a student of knowledge in a land where the ruler orders prayer to be performed (janāzah prayer performed in a distant land) over him, than a person should pray over him and leave his (Ṣaddam's) affair to Allāh.
